Q: can an HOA resident be denied install of solar array on a 5 ac lot due to neighbors disapproval
Colorado Revised Statute 38-30-168 specifically states "hoa cannot deny install of solar panels in the first section of the statute then in 2nd section it states para 1 does not apply to para 2 and lists reasons why the hoa can deny install for such things as "aesthetics, view, etc" which make the statue rather ambiguous and subjective in nature. Have found only property values going up from individual solar array installs which was one neighbors concern. what precedence might clear up the confusing nature of this situation.
