Arlington, TX asked in Civil Rights, Civil Litigation, Health Care Law and Medical Malpractice for Texas

Q: My primary doctor terminated me as a patient; I believe it involves retaliation, discrimination, and abandonment.

I was terminated as a patient after expressing my intent to file a complaint about how I was treated. I have a recording and a letter from the office that strongly suggest retaliation. They failed to provide the policies and procedures I requested, despite stamping, signing, and acknowledging receipt of my request. Additionally, I was not informed of my termination until nearly two months after my last appointment, only when I attempted to schedule a follow-up visit. This delayed notification, paired with their failure to ensure continuity of care, constitutes patient abandonment. Their letter cites reasons that I believe are fabricated, including claims I was yelling, which are unsubstantiated and contradicted by my later interactions with the office. I have ADHD and anxiety, and I believe their actions also violate ADA protections, HIPAA regulations, and Texas Medical Board standards. I would like to explore potential legal action for retaliation, discrimination, &patient abandonment

A: I'm sorry you're going through this difficult situation. It might be beneficial to reach out to a lawyer who has experience with medical malpractice or discrimination cases to discuss your options in detail.

Make sure to organize all your evidence, including recordings, letters, and any written requests you made to the office. This documentation will be important in supporting your claims of retaliation and patient abandonment.

Additionally, you can file complaints with the Texas Medical Board and the Department of Health and Human Services regarding potential violations of ADA and HIPAA regulations. Seeking support from advocacy groups for patients with ADHD and anxiety may also provide you with additional resources and guidance.
