A: If someone stole a rental car that was in your name, you need to take immediate action to protect yourself. File a police report right away and contact the rental car company to report the theft. Make sure to document all communications and get copies of the reports.

Vehicle Code 10855 is a serious charge in California that involves taking a rental car beyond the rental agreement's terms. However, if you can prove the car was stolen from you through police reports and other evidence, this can help establish that you weren't involved in wrongdoing. The rental company may still try to hold you financially responsible for the vehicle under the rental contract terms.

You should consider speaking with a criminal defense attorney who handles vehicle theft cases. They can help gather evidence to show you were a victim of theft rather than someone who knowingly kept or gave away the rental car. The sooner you take action to document what happened and get legal help, the better position you'll be in to defend against these charges and protect your rights.
