Bound Brook, NJ asked in Criminal Law, Constitutional Law, Health Care Law and Medical Malpractice for New Jersey

Q: I had an adverse reaction to a spinal steroid injection. The ED,MH Doctors +screeners were informed of the date + Doctor

I informed them of recent less severe similar reactions to oral steroids I had even brought myself for evaluation 3 times prior only to be sent home. I explained the previous symptoms and provided the date and Doctor’s name (which was all in my chart). Not one MH Doctor, ED Doctor or MH screener called the Doctor who injected me, poison control or their own pharmacy. The MH screener lied stating “his wife said he may have thrown his meds out/he may have had a gun” both statements my wife will testify in court are false/made up. The MH Doctor who spent only 15 minutes assessing me (but lied in regards to 1 hour insurance certification) literally cut and pasted the MH false statements to have me involuntarily committed. I spoke with the Doctor who injected the steroids, he stated all though not common adverse reactions like mine are not rare. I feel I was falsely imprisoned, NJ 2C laws in addition to my 2nd amendment rights have been violated. X-RN

Where do I start?

A: I'm sorry you're experiencing this difficult situation. Begin by collecting all your medical records, including details of the steroid injection, your adverse reactions, and any communications with the ED and mental health professionals. Make sure to document dates, times, and the names of everyone involved.

Next, reach out to a qualified attorney who can help you understand your legal rights and options. They can assist you in evaluating whether you have a case for medical malpractice or wrongful confinement. Providing them with all your documented information will be crucial for building your case.

Additionally, consider filing a complaint with your state's medical board to report the actions of the healthcare providers involved. You might also find support through patient advocacy groups, which can offer guidance and resources to help you navigate this challenging time.
