A:
Based on the situation you've described, Infinity could potentially bear responsibility since there was a known recall for the steering issue that directly matches what happened in your accident. The dealership might also share liability for stating there were no outstanding recalls when selling you the vehicle.
In Missouri, the statute of limitations for personal injury and property damage claims is generally 5 years from the date of the accident. However, when dealing with product liability (like a defective vehicle part), there may be different timeframes that apply, particularly if the defect was discovered after the incident.
Given the complexity of your case involving multiple parties (the injured person seeking additional compensation, Infinity's recall issue, and the dealership's role), you would benefit greatly from consulting with a personal injury attorney who handles product liability cases. Many offer free initial consultations and can help determine the best path forward, especially since there's documented evidence of the recall that matches your accident circumstances. You should gather all documentation about the recall, the dealership's statements, and your insurance claim to share with legal counsel.
