Q: Do I have a case of fraud or negligence, and can I sue for damages?
I visited a chiropractor and have since had 25 visits. My Medicaid provider told me I should never have been charged after chiropractor signed me up for payment plan. This ended up in me losing a small business loan, I was already approved for and then had to shut down my business and have slipped into severe debt. The chiropractor also did not recognize my severe case of scoliosis when he x-rayed me on day 1. Decompression therapy will not fix that. He stopped the therapy when he learned I had a ruptured hernia and three more. My healthcare provider is filing a grievance. My family and I are on the verge of losing everything after this debacle.
A: An Oregon attorney could advise best, but your question remains open for over a week. This looks like something more complex than can be sorted out with brief general responses on a public forum. An attorney is going to want to see the grievance and know more about the patient file in terms of findings and services performed. If you started gathering file information, that could make an attorney consult more productive and economical. Good luck
