Phoenix, AZ asked in Criminal Law and Domestic Violence for Arizona

Q: How do I prove ineffective counsel?

My girlfriend was arrested for DV assault for fighting with her adult daughter. The daughter struck first, was blackout-drunk, and my girlfriend defended herself and neutralized the situation, left on foot as her daughter called the police, and was arrested almost two blocks away. The neighbor admits to giving the daughter moonshine and getting her drunk, all on body cam, but no toxicology was done on the daughter. The fight started because my girlfriend wouldn't let her daughter drive home drunk with the kids in the car, and told the daughter she would drive them back home and get another ride home herself. She had just gotten off work driving a taxi, and her co-worker can attest to her sobriety. My girlfriend's attorney hasn't done anything but convey the rotten plea from the DA and tried to get her to take it. She's never done a sit-down with him, he's called her once only after I said something to him. Should we motion to dismiss him yet?
