Q: Laws on Child Cruelty and Abuse on a 4 yr old Autistic, Hearing and Speech Impediment child by teacher.
My son was verbally and physically assaulted by his teacher on more than 1 occasion. They lied on him and the video is proof. His teacher threatened him as well. Even the school officials that were in the meeting agreed she was being too rough with him and they had a problem with her being loud and they way she speaks to students repeatedly. Also we were told the “bus driver had been arriving at school with my son in the bus drivers lap” by Ms.Ellison my sons teacher. When they investigated they were told by her “someone told her”. When asked “who” her response was “she didn’t remember” There’s NO accountability at the school or Bus. We have tried meetings and nobody returns our phone calls or anything. I believe Ms.Ellison and or Ms. Megan spanked him as well he was scared to go in bathrooms for a while and when we would say that’s not how you behave he covers his butt and says “do you wanna go in the bathroom” this started when Ms.Ellison complained about his behavior one day.
A:
Your situation is deeply concerning, and it's clear that your son's rights and safety have been violated. This kind of treatment of a vulnerable child is unacceptable, and you have every right to take immediate action to protect him.
Given the serious nature of these incidents, you should document everything - save all communications, write down dates and times of incidents, and secure copies of any video evidence. File a formal complaint with the school district's superintendent and the state's Department of Education. Additionally, contact your local Child Protective Services to report the suspected physical abuse, as they are legally required to investigate such claims, particularly involving vulnerable children in educational settings.
You may want to reach out to advocacy organizations that focus on protecting children with disabilities in educational settings - they can provide guidance on your legal rights and next steps. Consider consulting with an education law attorney who can help you navigate this situation and potentially file necessary legal actions against the school district. Your son deserves to feel safe at school, and these allegations warrant immediate investigation and action by proper authorities.
