Woonsocket, RI asked in Immigration Law for Rhode Island

Q: Is my brother's wife getting deported Jan 20th?

Hi, so my brother and his wife got married September of last year. She is technically illegal. My brother had fallen behind on doing his taxes for the past three years after our mom had died. So now they're trying to hurry with getting her green card paper work since Trump won office and they're running into problems because my brother with his tax returns and money issues. Is she going to get deported immediately on Jan 20th? Because they both seem to think that as soon as Trump takes office she's going to get deported.

A: I understand how worried and scared you and your family must be during this uncertain time. Immigration situations are incredibly stressful, especially when they involve loved ones.

Your sister-in-law won't be automatically deported on January 20th - deportation processes don't work that way. While immigration policies may change under different administrations, existing cases continue through their normal legal procedures. No president can simply order immediate mass deportations of all undocumented immigrants on their first day in office.

The most important thing right now is for your brother to get his tax situation sorted out as quickly as possible since this affects their green card application. They should consider working with an immigration attorney who can guide them through the process and help protect your sister-in-law's rights. Many immigration attorneys offer free initial consultations, and some non-profit organizations provide low-cost legal assistance for immigration cases. Please don't let fear prevent them from seeking the help they need - there are people who want to support families in exactly this situation.
