Q: If my money was seized from a possession of less than one gram of meth and my charges were dropped.can I get my money

They seized $2000 dollars from and after my charges were dropped the courts never sent any notices about my money.its been a couple of years and I haven’t heard anything

A: Law enforcement can seize money if there is evidence it was related to drug sales and proceeds regardless of the disposition of the criminal charge. However, they have to file an action in civil court in order to do this. You have to be served with notice of their intent in formal pleadings and given the opportunity to respond. If this has not happened, and you did not consent the money over during your criminal case then you could potentially recover the money confiscated. The issue you are likely to encounter is that the amount of money in question is less than what most attorneys would charge to represent you. Call around for an attorney in your area, and not necessarily a criminal defense attorney as you will need someone with experience in civil litigation. Best of luck
