Q: I was charged 3/16/2016 a DWI and a refusal to submit to a chemical test. I went to court October 24 of 2016.
I thought in the state of Minnesota you didn’t have to report stuff on an application after seven years so why is it still showing up on a background check for employers? It’s nonviolent and it has nothing to do with money?
I’m sure I’m OK because I’ve never had an issue finding a job, but I’m coming up on nine years and I’m just curious why this background check from first advantage is still showing this.

A conviction for DWI in Minnesota essentially stays on a record for life, unless it is sealed through expungement. Also important to note is that although it happens from time to time, judges tend to shy away from expunging DWI cases and DWI convictions do not qualify for automatic expungement pursuant to the recently enacted MN Clean Slate Act.
