Q: Can a signed separation agreement in Virginia (that states irrevocable) be changed in any way in the actual divorce?
He offered to pay a hefty amount per month in alimony and give up full rights to the house - amongst a few other things in the signed agreement. Since, he stopped paying all together and refused to sign over the house. Now, I've filed for divorce and he's trying to get it all changed. Is that possible? The agreement specifically states it's irrevocable (with laymen's terms stating what that means written along with). He wasn't out of his mind or forced in any way to agree to these terms. He did and is still capable of having more than enough income to cover it and has no need for the house. (I do, I have kids - not his)
A: the answer really depends on what is written in the agreement as to whether the alimony (spousal support) is modifiable. You may need to have a lawyer review your agreement to answer your questions.
