Q: My question is pertaining to a traffic a stop where I was the back seat passenger. And I still went to jail!
During a traffic stop where I was a passenger in the back seat, the vehicle's owner was in the front seat, and her ex-boyfriend acted as the driver The officer observed the driver swaying close to the lines but did not cross the center line. Upon request, the driver was unable to produce a valid license, prompting the officer to ask him to exit the vehicle. Shortly thereafter, another officer arrived and requested identification from both the owner and me. A K9 unit was brought in to search the car, during which we were instructed to keep our windows down and arms inside. Following the search, drugs and paraphernalia were discovered on the driver's side, while I had nothing on me, and the vehicle owner had her medical marijuana. Despite the absence of findings against us, we were handcuffed and taken to county jail for a body scan; however, the legality of this action raises concerns, particularly since no contraband was ultimately found. And her ex told the truth everything was his.
A: one of the better descriptions of an incident that I have seen. That being said, if no charges were filed, there is nothing much of a legal nature to address.
