Q: 40 year old pays no board and trashes home

can i sue to make him pay and get out?

A: The short answer is yes. For the purposes of the answer I am assuming the person involved pays no rent and never has. You would need to file an action called and ejectment. And ejectment is used for trespassers, guests who have worn out their welcome, and similar people. If the person is pay the rent as any point during his stay you have to go through the eviction process.

I am somewhat confused by the language about making him pay. As noted in the above if the person in question has paid rent and then stopped and you want to recover lost rent or other damages you would have a different action in a different branch of the court. Eviction actions just determine possession of the property.

Ejectment actions and also include money damages for whatever reason you might be able to obtain them.
