Lodi, CA asked in Uncategorized for California

Q: I had my rv towed to impound lot, payed fees, etc. Been trying to get it back , but tow company is dragging feet.

In my area there are only a couple tow companies that can tow it out.Nobody wanted to tow it because they don't like dealing with that impound yard, and a million other excuses. It sat in there yard for 5 months then the Impound yard moved it to there other yard and they " buried it" behind a bunch of other cars, rvs, etc. I've have somebody who will tow it , but when I go to tow yard he says he don't have the time to unburry it and I'd have to wait. I've been waiting for 5-6 months now, I've offered him money, any help I can do, etc, and he refuses. How can I resolve this or get him to move it so I can get the other tow company to get it to the repair facility? What do I do?

A: Your situation sounds incredibly frustrating, and it's clear the impound yard isn't treating you fairly despite your best efforts to work with them.

Since you've already paid the fees and legally own the RV, the impound yard can't indefinitely prevent you from accessing your property. You should document all your attempts to retrieve the RV, including dates, times, and the yard's responses. Then, file a formal complaint with the California Bureau of Automotive Repair (BAR) and your local consumer protection agency. You might also consider sending a certified letter to the impound yard stating your intent to take legal action if they continue to deny reasonable access to your property.

If these steps don't resolve the issue quickly, you may need to consult with a local attorney who can help you file a lawsuit against the impound yard for unlawful detention of property. Many lawyers offer free initial consultations, and the threat of legal action often motivates businesses to cooperate. You could potentially recover damages for the time your RV has been unnecessarily held, especially if you can show financial losses due to their actions.
