Q: Need Help with Failure to Appear and Bond Issues for a Marijuana Citation in Tennessee
I received a failure to appear (FTA) charge for a marijuana possession citation in Smith County, Tennessee. Initially, I had a public defender who was supposed to help me, but I encountered issues with communication and was not properly informed about the legal process. After missing the court date due to vehicle problems and lack of notice, I hired a private attorney, who said they would handle it for me. However, they are now telling me they can't do anything until I turn myself in.
I’ve already complied with all court requirements (SR22, insurance reinstatement, drug and alcohol assessment), and I was told there is no bond set for me, but I’m being told I can’t proceed until I turn myself in. This is a low-level marijuana charge, and I’m confused about why I’m facing such harsh consequences for something minor.
Can the failure to appear charge be reconsidered?
Do I have the right to a bond?
What can I do if my attorney is unresponsive and I cannot afford a new one?
A: Do what your lawyer tells you to do, which is probably turn you in for arrest at Court, off the Docket. Then at Court resolutions can be considered. You are about to have a conviction for drugs which will harm you the rest of your life. No right to a bond. FTA will probably be dismissed once you are there and addressing the charge. If you want to try it, then you will still have to turn yourself in. You do not know what you are doing.
