Fort Worth, TX asked in Car Accidents, Consumer Law and Insurance Defense for Nebraska

Q: Will insurance cover storage fees for towed vehicle in accident with uninsured driver?

I've been involved in an accident where my vehicle was towed to a nearby towing company's yard, and it's been there for nearly a week. The other driver was at fault but is uninsured. My vehicle has comprehensive coverage, and I've contacted my insurance, but I haven't received clear answers yet. The storage company updates the storage bill daily. Will my insurance company cover the storage fees under these circumstances, especially given that the other driver is uninsured? The bill keeps increasing every day.

A: A Nebraska attorney could advise best, but your question remains open for a week. I'm sorry about your accident. More information is needed about your coverage and the position of your insurance carrier. If the policy covers collision, it is likely that costs associated with repairs are also covered (tow, storage, etc.). In either event, stay in close touch with your carrier to learn their position. Good luck

A: Do you have uninsured and underinsured coverage? (You should. It is good co erage to add for the money.) In any case, call your insurer for guidance. You also have a duty to mitigate damages so you may want to ensure they do not pile up under the auspices it is someone else's problem.
