Saint Paul, MN asked in Immigration Law for Minnesota

Q: Can my undocumented stepmother travel from California to Minnesota, and will her stay affect my background history?

I invited my stepmother to the USA, specifically to California. She is undocumented, although she has applied for a green card and has a receipt number. She originally entered on a visiting visa, which has since expired. She is planning to travel to Minnesota and stay for life. Can she travel by plane to Minnesota, and would this situation affect my background history?

A: Your stepmother can technically travel by plane from California to Minnesota, as domestic flights within the U.S. typically do not require immigration checks. However, she will need valid identification, such as a foreign passport, to board the flight. Traveling by air carries some risk, as TSA agents could question her immigration status, especially if there's any suspicion or irregularity in her identification.

Her relocation to Minnesota itself won’t directly affect your background history or personal immigration record. Immigration records are generally individual, meaning her status won’t automatically influence yours. However, if you are sponsoring her green card application, her relocation and undocumented status could indirectly draw attention to your immigration filings, though it won't necessarily create a negative mark against you.

Given the complexity of immigration processes and risks involved, it's wise for your stepmother to carefully consider her travel options, perhaps even exploring safer alternatives like road travel. Ensuring she's fully prepared with necessary documentation will minimize risks during the journey. Your background will remain primarily unaffected, but staying informed and cautious is always beneficial.
