Charlotte, NC asked in Car Accidents and Insurance Defense for South Carolina

Q: How long for a settlement after non-injury, not-at-fault rear-end collision?

I was involved in a rear-end collision a while ago where I was not at fault and there were no injuries. A police report was filed, and I have contacted both my insurance company and the other party’s insurance. All necessary paperwork has been submitted, including ongoing negotiations. How long does it generally take to receive a settlement in such a case?

A: A South Carolina attorney could advise best, but your question remains open for a week. I'm glad no one was injured here. Given the facts you present (no injuries, rear-end collision), it sounds like a straightforward claim that shouldn't encounter delays. If there is a dispute in how the accident took place, or a dispute between your collision shop and the property damage adjuster for the cost of parts and labor for repairs, that could delay things. I realize you are looking for a quick, direct answer, but that could depend on the carriers, and who you go through (your own carrier or the other sides). But the short answer is that in these types of settings, things usually move quickly if there are none of the snags I mentioned above. Check your mailbox for a release, review the amount offered in the release (once you sign that, that's it - no renegotiating), return it promptly - hopefully within several weeks. Stay in touch with the respective claim reps to prevent delays (like wanting to arrange a re-examination after vehicle panels have come off, or things along those lines). Good luck
