Asked in Family Law and Child Support for Kentucky

Q: Is it legally required to establish a child support order, even if both parents agree not to?

We have finalized custody through the Chesapeake, VA, court, granting joint custody and visitation. We have mutually agreed to share financial responsibility for our child without a formal child support order. Since both parents are committed to providing for the child, we want to know if Kentucky law allows us to proceed with our uncontested divorce without including child support in the case

A: Yes, but the agreement needs to recite that you have consulted the guidelines and agree to deviate from them in the establishment of child support.
