Q: Injured at work as a delivery driver, facing termination after filing workers' comp. What are my options?
I was injured on 12/16/24 while trying to pick up a box as a delivery driver, resulting in a lower back injury. The vehicle had cameras inside and outside for evidence. I reported the injury to my employer and filed a workers' compensation claim. I'm experiencing severe pain and difficulty walking, making it challenging to perform certain jobs. While I have received communication from the workers' compensation insurance and partial medical attention, I am waiting for MRI approval and potential surgery. My employer disputed accommodations and I was eventually terminated. What are my options for pursuing workers' compensation benefits, and how can I address the termination considering my injury-related restrictions?

I am sorry to hear of this unfortunate situation.
You still have the right to full workers compensation benefits even though you were terminated. Those do not end with termination.
With respect to the terrmination, there is a law in Nj against retaliatory termination for asserting a claim, but I would have to know more. Suffice it to say, these are difficult claims to prove.
You should pursue the WC benefits as they are significant.
