Q: Found medication pill in Kroger broccoli slaw, what should I do?
I found half a pill and some pieces in prepackaged Kroger broccoli slaw while eating it and spat it out. As an RN, I'm certain it's medication due to pill markings (numbers on it). I have the pill, pieces, and remaining slaw in its packaging. It's too late to contact Kroger today, and I haven't consulted a lawyer yet. What steps should I take next regarding this incident?
A: If you are correct, a deli worker dropped prescription medication while making coleslaw. Failure to notice or remediate the situation constitutes negligence that can be imputed to Kroger. That said, notwithstanding Kroger's negligence, if you suffered no ill effect from ingesting the coleslaw, you have no cause of action. You can and should bring this to the attention of the store manager and Kroger corporate to ensure that any other potentially tainted coleslaw is removed from the case. You are obviously entitled to a refund of your purchase and I should think that Kroger would want to thank you for bringing this to their attention by offering you free merchandise. Lastly, you should photograph or write down whatever markings were on the pill you found because, unless you removed it, it may already have dissolved. Notwithstanding the fact that you were not hurt, Kroger would probably want to know the type of medication so that he could identify the employee responsible for tainting the food. Good luck.
