Q: Can I sue my builder for faulty roof construction damages?
I want to know if I can sue my builder for damages from a faulty roof construction on my 5-year-old home. The roof had incorrect underlayment installed for a metal roof, leading to rotted wood and ceiling water damage in two locations. The warranty states 1 year for cosmetic issues and 7 years for structural issues, but the builder claims the roofing isn't structural. The first leak occurred a few months after moving in, and subsequent repairs were poorly executed, such as caulking over bad caulk. The builder blames the roofing subcontractor, who has no solution.
