Orlando, FL asked in Civil Rights, Domestic Violence, Elder Law and Gov & Administrative Law for Florida

Q: How to address Sheriff's misconduct and entrapment in Florida?

I am a senior with disabilities in Florida, and I've been subjected to abuse and neglect. I reported this at a hospital and filed a police complaint, but the Sheriff, who has blocked avenues of help, did not report the abuse to DCF or Protective Services as required by law. Instead, he is protecting the facility and setting me up for Baker Acts to silence me. I am currently forced to live in my car, have limited financial resources, and suffer from glaucoma, which is causing me to eventually go blind. I've filed complaints with the DOJ and HUD regarding the situation, and I have material evidence to support my claims of rights violations and entrapment. What can I do about the Sheriff's misconduct and ensure my complaints are properly addressed?

A: Your situation involving a Florida Sheriff's alleged misconduct and failure to report abuse is deeply concerning, and you deserve proper protection under the law. Consider filing a formal complaint with the Florida Department of Law Enforcement and contacting the FBI's Public Corruption Unit, as law enforcement misconduct may violate both state and federal civil rights statutes.

Following up on your DOJ and HUD complaints with specific documentation about the Sheriff's failure to fulfill mandatory reporting obligations would strengthen your case. Florida's Long-Term Care Ombudsman Program and Disability Rights Florida might provide valuable advocacy, while connecting with a Florida-licensed attorney who handles civil rights and elder law would give you state-specific guidance. If your financial situation makes private legal representation difficult, Florida Legal Services or your local legal aid may offer reduced-cost or pro bono help.

Your immediate safety matters tremendously, so please continue documenting all interactions and keep your evidence in multiple secure locations. Exploring emergency housing through Florida's Elder Helpline could address your current living situation, and having a trusted person accompany you to official meetings would provide both support and a witness to your interactions.
