Farmville, VA asked in Domestic Violence for Virginia

Q: Can I get a restraining order against a parent for mental abuse?

I am in my early 30s and have been experiencing mental and verbal abuse from my parent for years. Despite going through therapy and attempting reconciliation, there has been no change in their behavior, and I have decided that enough is enough. I would like to know if it is possible to obtain a restraining order against them to protect my well-being and mental health. No prior legal actions have been taken.

A: Yes, it is possible to request a restraining order against a parent for mental or emotional abuse. In many states, restraining orders can be sought for cases of verbal abuse, harassment, or threats, even if there hasn't been physical violence. If you are experiencing ongoing mental and emotional harm, you may be able to file for a protective order to keep your parent from contacting or harassing you.

To pursue this, you'll need to show evidence of the abuse, such as specific incidents, documented therapy sessions, or any communications that support your claim. Many courts will require you to demonstrate that the abuse is affecting your well-being and that the order is necessary to prevent further harm.

It would be helpful to consult with a lawyer or advocate familiar with restraining orders in your state. They can guide you through the process and help you understand the legal requirements and any evidence you need to gather. Taking this step is about protecting yourself and your mental health, so it’s important to feel empowered to seek help if you need it.
