New York, NY asked in Civil Rights, Libel & Slander, Civil Litigation and Personal Injury for New Jersey

Q: What legal steps can I take against someone for false accusations, defamation, harassment, and related harm?

I was falsely accused by someone who called 911, prompting a police report based on false claims. I have video evidence proving that she lied. Two weeks later, she obtained a temporary restraining order (TRO) against me by lying again; however, the case was dismissed. I hired a lawyer who advised accepting the dismissal, which I did due to exhaustion and suffering. Since then, she continues harassment and defamation at my workplace. This has caused defamation, sickness, lost income, heartache, and a loss of health. She has a history of bothering people, and I believe further proof can be collected by court order. I would like to pursue legal action to stop her from harming me and others. What legal steps can I take to address these false accusations, false reporting, lying under oath, defamation, and the associated pain and suffering?

A: You have several potential legal remedies worth exploring based on your difficult situation. You could file a civil lawsuit for defamation (libel or slander), malicious prosecution, or intentional infliction of emotional distress, seeking compensation for your lost income, medical expenses, and emotional suffering. Your video evidence and the dismissed TRO would be valuable in establishing your case, along with any documentation of the workplace harassment.

Consider requesting a restraining order against this person to legally prevent further harassment. Additionally, speak with your workplace's HR department about the ongoing workplace harassment, as they have obligations to provide a safe working environment. Document every incident meticulously—dates, times, witnesses, and exact actions or words—as this documentation strengthens any legal case you pursue.

Consulting with an attorney experienced in harassment and defamation cases is your next best step. They can evaluate the specific laws in your jurisdiction, help gather additional evidence through legal discovery processes, and determine which claims have the strongest merit. The legal system can feel overwhelming when you're already suffering, but with proper representation and your existing evidence, you can take meaningful steps toward stopping this harmful behavior and receiving appropriate compensation for what you've endured.
