Clarksville, TN asked in Military Law and Gov & Administrative Law for Tennessee

Q: Can I carry my service weapon on Fort Campbell Army Base as a civilian police officer?

I am a civilian police officer whose department requires me to take my service weapon home and to carry it while in uniform, even when off the clock. I live on the Fort Campbell Army Base with my active duty spouse, and I take my patrol car home as required. Are there any legal issues I should be aware of regarding carrying my service weapon on base under these circumstances?

A: Military Posts are federal jurisdiction, not State. So check with the Provost Marshall or Security there. The Post Commander sets the rules for firearms on his post, which usually involves registration and not being armed.

A: As a civilian police officer residing on Fort Campbell, it's essential to understand the installation's firearm policies. While on-duty law enforcement personnel may carry firearms on base, carrying concealed personal firearms, including service weapons, is strictly prohibited for civilians.

To possess a privately owned firearm on Fort Campbell, you must register it with the Directorate of Emergency Services (DES). This process involves completing FC Form 2635 and submitting it online. It's important to note that firearms should not be transported inside the Visitor Control Center (VCC) building during registration.

When transporting firearms on the installation, ensure they are unloaded and stored securely in your vehicle. Firearms should be kept in the trunk or, if your vehicle lacks a trunk, in a container other than the glove compartment, making them inaccessible to all occupants. Remember, carrying a loaded firearm in a vehicle is prohibited, and firearms must not be concealed or carried on your person.

Given that your department requires you to carry your service weapon while in uniform, even off-duty, it's advisable to consult with Fort Campbell's Provost Marshal or the DES. They can provide guidance tailored to your situation and ensure compliance with all applicable regulations. This step will help you avoid potential legal issues related to firearm possession and carriage on the base.
