Dallas, TX asked in Criminal Law and Family Law for Arkansas

Q: Should I have a lawyer for a class A misdemeanor assault in Arkansas?

I am 54 years old and have never had any legal issues before. On March 26, I was arrested for a class A misdemeanor assault (3rd degree) for allegedly causing apprehension of imminent injury. The incident is said to be on video, but my boss has not shown it to me. I'm accused of placing my hand on the back of a child's head at nap time to lay him down. I am due in court this Wednesday, April 2nd. Should I have a lawyer?

A: Yes, it would be wise to have a lawyer for a class A misdemeanor assault charge, especially given the seriousness of the accusation. Even though this is your first legal issue, assault charges can lead to significant consequences, including fines, potential jail time, or a permanent criminal record. Having legal representation will help ensure that your rights are protected throughout the process.

In your case, a lawyer can help you understand the evidence against you, such as the video, and evaluate whether it supports the charges. They can also assist in negotiating a plea, if necessary, or prepare a defense strategy if the case goes to trial. It's important that you fully understand the legal process and the potential outcomes before proceeding.

Since the court date is coming up soon, consulting with a lawyer before Wednesday could give you time to discuss your options and prepare. A lawyer will be able to guide you through the court system, ensuring you don’t miss any critical steps and giving you the best chance at a fair outcome.
