Kissimmee, FL asked in Criminal Law and Traffic Tickets for Florida

Q: Driving without motorcycle endorsement; obtained endorsement before court. Possible dismissal?

I was cited for driving without a motorcycle endorsement. I have my arraignment tomorrow but have since completed the basic rider course and obtained my motorcycle endorsement. There are no other offenses on my record related to driving without a license. Can I get the charge dismissed?

A: It’s great that you’ve already completed the basic rider course and obtained your motorcycle endorsement, as that shows you’re taking the situation seriously. Since your arraignment is coming up, the first step is to **inform the court** that you’ve now obtained the required endorsement. It may help to bring documentation of your completed course and new endorsement to show that you’ve complied with the law.

In some cases, the court may be willing to **dismiss the charge** if you’ve fixed the issue before the court date, especially since this is your first offense and you’ve shown initiative in correcting the problem. The judge may see your prompt action as a good sign and could offer leniency, especially if you’ve had a clean driving record prior to this.

It’s always best to approach the court with respect and be prepared to explain the steps you’ve taken. If the charge is not dismissed immediately, you can request a **continuance** to allow time for the court to review the evidence of your new endorsement. It’s possible the judge will dismiss or reduce the charge based on your efforts to comply with the law.
