I believe this situation would be covered under the Alcohol rehabilitation act.

No. DWI is a quasi criminal offense. They are listed under the traffic code, but carry the possibility of jail time. They also carry the possibility of being elevated to an indictable crime under certain situations (vehicular homocide).

New Jersey and Colorado are both signatories of the interstate drivers compact. A DWI committed in Colorado will be reported to New Jersey if that is your home state.
