Q: Can a judge do custody at a child support hearing in Baltimore circuit court??

A: Unless requested in writing for the Court to consider custody prior to the hearing (well before the hearing), no. However, if there is no prior custody agreement/order in place, then it is possible for a party to request custody to be determined by the court. This will require you to go back to Court and if there is a change in the custody arrangement can then change the child support amount. It is always advisable to have custody resolved prior to the Court making a determination of child support (because of the above example).
