Q: My ex husband was ordered by court to pay 1191 in child support. Yesterday he called me and told me he can only pay 491

He was ordered to pay 1191 every month but know he told me he can pay only 491 because he is about to lose his house and is afraid to lose his security clearance. Can he just do that without a modification of child support ? And how can i contact about this?

A: Depending on what the Order said about how child support is to be collected (i.e. directly to you or through the Office of Child Support Enforcement Agency ("OCSE")), will determine what you can do. If it is directly through you and OCSE is not involved then you have to wait 30 days from the date that the support was originally due and owing and then file for Contempt (you may be able to do this with OCSE by paying them a one time fee of $25). If OCSE states it cannot assist you then contact an attorney to schedule a consultation to advise you of the rights and options you have.

If payments are to be made through OCSE, then OCSE has a system to enforce individuals like your ex and you should contact OCSE who can advise them what steps they will take and when (i.e. garnishing wages, tax returns, assets, etc).
