Q: I have an 18 year old daughter in FL that moved out to live with her fiance, do I still pay child support to the mother?

The agreement was under Florida Law. In the agreement I owed back child support that was to be paid in conjunction with regular child support. Once the child support payments stop the same amount was to be paid until the back support was completed. If my daughters moving out is an emancipating event then all the payments will count toward the back support taking six months off my payments. I need to know if my ex is still entitled child support even though my daughter no longer resides with her?

A: The thing that you must do is get to an attorney and get a court order entered either by agreement with the ex or by a trial. The changes in circumstances must be found to exist, it just does not happen automatically as many believe. The court order remains in full effect until an order of modification is entered.
