Q: How to proceed to request the tenant to move out?

I am the property owner. My friend rents a room from me without signing a contract. My friend has been bringing his fries come over and stay with him. I can't take it anymore and told them to move out. My did not say anything but his friend claimed we can't ask them to move out. Please help...Thank you

A: You have to give your friend the required notice (30 or 60 days) and serve that properly. If your friend doesn't move after the end of the notice, you have to go to court to evict him. There is no way around having to go to court.

A: If your tenant is on a month-to-month tenancy, then you can give a 30-day notice to quit (60-day if he's been there over a year), then start the unlawful detainer proceeding.
