Q: I am a drug addict seeking help through an outpatient facility.Father is filing for full custody in ohio. Will I lose?

I used drugs throughout certain times during my pregnancy and baby tested positive. Since then CPS determined that a opening a case wasn't necessary due to my decision to start/continue treatment. Like I said I had a couple slips (dirty urine screens) but for the most part and all my recent drug screens are clean. A guardian ad litem was appointed and I was honesty. I'm truely committed to staying sober. My he father has hired a private investagter to follow me, is that legal? And am I going to lose custody? The father suggests me voluntarily give up custody and as long as I submit to his drug screens the baby will stay with me and nothing changes. He merely wants custody in case I screw up. He suggested this so he doesn't have to pay child support and has control to force me clean. He has control issues...I have an attorney but I would like your opinion . He works 60 hours a week and his home is not set up at all for a baby 3 mths old, which if course he'd huRry and fix his home.thx.

A: You should discuss this with your lawyer. It's inappropriate for us to give advice to folks who are represented. There is certainly a risk you would lose custody due to your struggles with addiction, but it is not a certainty and courts are hesitant to terminate a parent's rights altogether.
