Q: Can I take my son out of state, without his father doing anything? Neither of us have custody.

A: You mean neither of you have a custody ORDER. Both parents of a child normally have the right to custody, but unless an order is entered, that custody is shared.

If you take the child out of state without the father's permission, the father could sue you for custody and perhaps the court would order that the child be returned.
