Q: I've been charged with a few things by word of mouth and lies, a family member and cops are involved what do I do?

My sister and I got pulled over, she was driving and I was the passenger of the vehicle. They conducted a search and found a large quantity of meth some paraph. marijuana, scale baggies etc. They searched me and found a quarter gram on my person . They ask who the drugs belonged to I said I don't know I didn't even know they were there. They arrest me my sister drives away with my daughter later on I find out I'm being charged with everything found in the vehicle. The cops said I signed and confessed to everything, my sister pointed the finger at me and everything was hers with the exception of the quarter gram I got from her the night before what can I do

A: First of all, I’m sorry you’re going through this. The crimes you’re facing a very serious. The meth sales alone, have a punishment of five years prison minimum, 10 years prison presumptive, 15 years prison maximum. And that’s flat time.

Any scales, baggies, ledgers, can be used as indicia and sales. The meth found on your person can also be a problem obviously.

First piece of advice is always don’t allow a search of your car if asked, tell the police you want to remain silent and not speak to them.

If indeed you did write a statement, you need to go to a lawyer and see if there’s anyway that statement can be thrown out as coerced or involuntary. Do not speak and Jail phones if you’re incarcerated because all the calls are monitored and tape recorded as evidence.

A: Hello and sorry you are in this situation. When it comes to possession, everything in a car technically is possessed by everyone in the car. If no one takes the blame, all the occupants can be charged. Apparently, your sister blamed you and the police bought her side of the story. If that is the only evidence they have that the drugs belonged to you, you may have a defensible case. You will need the assistance of an experienced criminal defense attorney.
