Asked in Immigration Law for District of Columbia

Q: Can I seek asylum based on my sexual orientation if I am a minor (16 y.o.), I live in Egypt.

Homosexuality in Egypt is a crime punishable by ~15 years in jail, and your future is probably ruined (same with your reputation), assault in prison is inevitable.

My parents are emotionally abusive and homophobic as well.

A: The general rule is you can apply for asylum based on sexual orientation if you are being abused in your home country because of your sexual orientation. You would have to prove fear of present persecution based on your sexual orientation and/or the potential of future persecution because of sexual orientation. Since it is illegal for you to express your sexual orientation in Egypt that would be a factor that would be considered in an asylum application. The fact that you are a minor is a complicating factor. You should consult with a qualified immigration lawyer to review your case in detail since your situation is complex.
