Phoenix, AZ asked in Personal Injury and Car Accidents for Arizona

Q: Do I get medically necessary contact lens (lost in a car accident) replaced by medical or by property damage coverage?

The other driver is responsible.

Marginal pellucid thinning is the disease that I have which makes the lenses medically necessary.

A: Wow this is a great question and one I have not thought about before. I would ask the at fault driver's carrier to cover the cost of replacement under the property damage portion of their claim. Remember that they should cover all property lost or damaged as a result of the accident. If there is not enough property damage limits then I would use medical payments coverage.
