Asked in Real Estate Law for Texas

Q: Do I have any legal options in a dispute with an RV park real estate deal that seems fraudulent?

Hello,

I have a question regarding the purchase of a plot in an RV resort park. It almost seems like this experience is an outright theft of my investment. Do I have any legal recourse? I would like to get my money back but thats not my primary motivation, rather, I do not want anyone else to go through what I went through and if we could stop this company from misleading any other consumers, that would be a great outcome.

A: In order to determine if you have legal recourse, an attorney will need to review the subject documents and discuss with you the particular facts and circumstances concerning your dispute with the RV park. You should contact an attorney with experience in contract disputes involving real estate in or near the county where the RV park is located. The complexity of the dispute along with the length and volume of documents involved will determine how much time an attorney may need to devote to analyzing the facts and researching the applicable law.

This is not the type of case likely to attract any interest in a contingent fee arrangement, so be prepared to pay a customary and usual hourly fee for an attorney in your area. For small, relatively simple disputes, many attorneys will agree to start work for an initial retainer as low as $5,000. For more complex disputes involving more voluminous documents, expect a larger initial retainer.
