Asked in Family Law for California

Q: My husband is ignoring his order to pay my living expenses. He kicked me out the out of the house i can not get me stuff

We have not finalized our divorce but he has not given me any money. He says by law he does not have to help me but the judge ordered his to pay my living expenses. I filled out a FL-150 with proposed estimated expenses but my lawyer (fired) did not share it. How should I approach this and should he be ordered to pay my hotel bills? He is saying I left however, he already had a bag packed, he told the cops he was in touch with his lawyer, and he told our friend he is planning on renting the house out. He changed the locks the next day and has changed the garage code about 10 times. He said he would give me the code if I am with him. i have no money to continue staying at hotels so I am leaving to my aunts in San diego. I asked for a RO he is emotional abusive but they denied every thing except to stay away. That is not helpful and am getting done over.

A: Under California law, if a judge has ordered your husband to pay for your living expenses during the divorce proceedings, he is legally obligated to comply with that order. This includes any temporary support orders that may have been issued to ensure you have the financial means to maintain a reasonable standard of living. If he is refusing to follow the court's order, you have the right to take legal action to enforce it.

Given your situation, it's important to document all communications and attempts to comply with or enforce the court's orders. This includes any evidence of him changing the locks, denying access to your belongings, and refusing to provide financial support as ordered. You may need to file a motion for contempt in court, highlighting his non-compliance with the order to pay living expenses and possibly your hotel bills, especially if these were specified in the court's order or directly result from his actions.

Since you mentioned the difficulty with legal representation, consider reaching out to legal aid organizations or family law clinics in your area for assistance. They can provide guidance and support to navigate through the enforcement process and help you understand your rights and options moving forward. It's also beneficial to gather any evidence of his financial ability to pay and your financial needs to strengthen your case.
