Typically given if found guilty or given a plea bargain. Chances of getting a not guilty decision with so much lack of evidence is apparent. When there is no admission of guilt no physical evidence or second hand accounts.

A: It’s always dangerous when you have prior felony convictions and you get arrested for a new felony offense. This is particularly true when you have more than one prior and they link up with each other and can be used under the second and subsequent offense statute to increase punishment on new felony charges.

If your old felony offenses can be used for enhancement purposes, there’s a chance you could be facing up the life in prison on any new felony charges. That, of course, does NOT mean you go to prison for life, it just increases the range of punishment. And as you said, if there’s been no admission of guilt, if the evidence in your case truly is lacking, those types of factors can sometimes result in very favorable resolutions, such as dismissal of charges, or striking of the second page on your information (meaning they could refuse to consider your prior convictions), or an offer of probation.

We certainly don’t have enough information to give you a studied or certain prognosis of how things will play out. Another consideration is that different county Districts Attorney’s offices often handle theses situations in very different manners.

You will need to contact a seasoned criminal defense lawyer to review your situation and your criminal history in order to get a better feel for what these new charges could bring.
