Q: If a not at fault driver leaves the scene without providing info, can they be charged with a crime?

My mother was responsible for a minor fender bender in a parking lot. There was minor damage (2-3 small scuffs & a chip in the paint) to the other vehicle. She gave her info to the other driver (OD)as required; but when she asked for the OD's name & info; OD was hostile & refused to provide any info. OD then threatened to call the police, and I told OD to go ahead and call the police (Since OD was hollering about replacing the door, the front panels, the wheel & tire, etc. I felt it was turning into a money grab. We waited for police to arrive, but after a few minutes OD just drove away. After that, we called the police and filed a report. OD has been ducking the police since then, but they did contact OD's passenger who said she's claiming back pain. OD has filed a claim with my mother's insurance company and is claiming massive damages and "serious injury". Is OD committing a felony & defrauding the insurance company? And can we file any charges against her?
