Avon, IN asked in Criminal Law, DUI / DWI and Divorce for Indiana

Q: Can I write a letter to judge asking for probation terms for a DUI conviction of a co parent - to protect my kids?

My kids dad got a dui. Has several prior about 10 years ago. He just filed a plea agreement. He has a sentencing hearing coming up and judge will set probation terms. Can I write a letter to the judge asking him to consider certain conditions of probation? Like requiring an ignition interlock device on the car he drives the kids around on his weekend? Or having to use soberlink during his parenting time. Also he has to do a lot of community service and he has our kids every other weekend. Can I ask the judge to require that community service only be done when he does NOT have the kids? I just want the judge to set some conditions to keep my kids safe when they are with him. Can I send a letter to the judge as?. Do I have to hire an attorney to contact the judge or prosecutors office? Or is there anything else that could be set in place to make sure he’s sober when he has the kids? Any suggestions are appreciated.
