Q: How do I recover a precious metals investor's commission fee that I was lied to about?

I transferred my mother's and my IRA from ***** to **** after my agent at **** told me that he did not take a commission fee. He said it was "worked in" when we bought the gold & silver. For the last 3 years, I have asked him where my $40,000 and my mom's $100,000 went after the transfer was completed (gold and silver have actually gone up in value, so I couldn't figure out the discrepancy). He (and his boss) kept telling me it was because of the spot value and that if I ever chose to sell back the coins, we would get the market value which would be more. Finally I got the truth when I spoke to his boss's brother in Feb of this year and found out that they took a 25% commission up front! He also told me a few days later that my agent went to bed one night and never got up, died in his sleep. Please let me know if I can take legal steps to recover any of this commission that they lied about. Thank you very much!
