Elkridge, MD asked in Child Custody, Child Support, Divorce and Family Law for Maryland

Q: Can a parent saying they are good with or without the kids be important enough to warrant a motion to modify custody?

I was awarded shared custody of my kids at our pendente lite last week and 3 days later my wife sent a long text message stating that if I do get sole custody "This is what’s going to happen I’m still going to live my life with my new husband, build my business and have more time to travel with him because you decided it was best for you to have the kids all the time. You're not hurting me you're just giving me more time to myself at the end of the day I have always been a good adapter. Something may bother me for a second then I’m over it. So, you can keep going down this hard road. I’m good and will continue to live my life, I have always been a go getter so there’s no amount of money you can take from me that’s going to bother me." Mind you this was sent to me just 3 days after our Pendente Lite to which she showed up without any paperwork or having completed court orders. Wondering if I can file a motion to modify custody from shared to sole custody with this text as additional.
