Elkridge, MD asked in Family Law for Maryland

Q: Can I still file a REQUEST FOR ORDER OF DEFAULT judgement if my counter complaint was never answered?

Pendente has passed but my wife has still not provided an answer to my counter-complaint after 4 months. She hasn't completed any court orders from the magistrate either from the scheduling order. She had the counter complaint delivered to her via certified mail in December when I filed it to the court. I still have the email receipt. Wondering if it's still possible to submit the order of default form and if it would be likely to be granted if she still doesn't provide an answer. Shared custody and no child support was granted at the pendente lite, and the judge didn't want to view any evidence at the hearing. I am seeking sole legal and primary custody along with child support. My wife also texted me after the pendente stating that she doesn't care whether or not I get sole custody as it will just give her more free time to travel.
