Brighton, MA asked in Estate Planning, Family Law and Real Estate Law for Massachusetts

Q: Does this clause allow me to make a cash gift to the irrevocable trust which I am a trustee and beneficiary of ?

I have 2 questions:

1) Id like to know if the clause below from a irrevocable trust I am both trustee and beneficiary of, which my aunt setup for estate and medicaid planning purposes allows me ( individually) the right to make a cash gift to the same trust ?

It states I can receive any property personal (which I believe means cash also) , including by lifetime means (which is a gift) from any persons (which I assume can include myself ) so assume I can, but Im not sure & would like to confirm.

POWERS OF TRUSTEE:

To receive any property, real or personal, to be added to the trust from the settlor in any event ( and if the trustee consents in writing from any other person ) by lifetime or testamentary transfer or otherwise.

2) If I can do so, how do I give written consent to do so, do I simply write & sign a document stating I as trustee accept the following cash gift (amount) from myself individually to maintain for trust record purposes?

THANKS
