Q: if someone is recording audio of me in Florida no consent, can I record audio of them asking if they are recording me?
I have security cameras around my house for general security and when I take road trips, some of the cameras look broadly and capture my yard mainly, some of my neighbors yard and the golf course. None of these cameras record audio and the motion detection is only set to record if there is movement in my yard or the golf course. Lately, every time I go outside, I see my neighbor pull out her phone, point it at me and follow me through my yard. I don't say anything but I am not sure if she is recording audio along with video. With Florida being a two party consent state and recording audio without consent being a felony, do I have to ask for her consent for me to record asking her if she is recording me using audio? Hope this makes sense....
