It really depends on what your fee agrement says. Please read carefully. Many criminal defense lawyers have 'non refundable' fees set forth in their fee agreement.

You can always change attorneys. Go get a second opinion, an if necessary change attorneys. The closer you get to the Statue, the harder it will get to retain a new attorney.
